A new lawsuit in federal court last week resurrects the legal case against President Trump for alleged false marketing by Trump University. Sherri Simpson, one of the plaintiffs who had filed suit last year and settled outside court, decided to submit an appeal against the settlement.

Trump faced three class-action fraud lawsuits related to Trump University last year and settled them all in November, shortly after the election, for a grand total of $25 million. There were more than 6,000 plaintiffs listed, all of whom claimed that the university had enticed them to shell out thousands of dollars each in order to learn the secrets of Trump's business success. The students all alleged that they learned nothing and that the material predominantly consisted of promotional pieces about Trump and his business dealings.

Simpson filed her appeal this week, claiming that she was never given the option to "opt out" of the settlement deal. Simpson said that she received no warning that the settlement would transpire and that she only got word of it when she heard it on the news.

Her case now rests with the ninth circuit court of appealsa court that ruled against Trump's travel ban earlier this month. If the court decides in Simpson's favor, Simpson could directly sue Trump for fraud. She told reporters that she hopes to make him testify before a jury.

"I believed in a jury trial," Simpson told the Guardian. "It looked like we had such a strong case for trial after seven years of litigation."

The court will likely issue a ruling late summer or early fall, according to Gary Friedman, one of Simpson's attorneys.
